“Client” means the individual or entity engaging MercProWeb’s services.

“Project” means the specific work to be performed by MercProWeb as outlined in the agreement or project proposal.

“Confidential Information” means any information disclosed by one party to the other that is marked as confidential or reasonably should be considered confidential.

Services

I offer various services, including website development, graphic design, and e-commerce solutions.
The scope of work will be outlined in a separate agreement or project proposal.

Payment Terms

Payment terms will be outlined in a separate agreement or project proposal. Late payments may incur additional fees.

Hosting and Domain Registration

I am not responsible for hosting or domain registration services, which are provided by third-party companies.
If you agree to use these services and pay for them, I am not liable for any cancellation or refund requests.
Clients are responsible for ensuring their hosting and domain registration services are up-to-date and paid for.
However, I can assist you in relocating or migrating your files and domain name to a different hosting provider if needed.

Warranty and Support

I offer a 30-day warranty period during which I will maintain your website, ensuring that all plugins and features are up-to-date and running smoothly.
After the warranty period, my support services will depend on the package you purchased.

Basic Package: You will need to pay a maintenance fee for my prolonged support.
Which includes plugin updates, security checks, and edits.

Medium Package: You will receive 1x monthly maintenance or edits.

Premium Package: You will receive 1x weekly maintenance with edits.

Refund and Cancellation Policies

My refund and cancellation policies are designed to ensure a fair and transparent process for both parties.
“If you wish to request a refund, please contact me via the email address provided upon purchase, referencing the project name and current stage.
I will process your refund within 10 business days of receiving your request.
Please note that refunds will be issued in accordance with my refund and cancellation policies “Refund Policy”

Project Stages and Refund Structure

My project consists of four stages:

Initial Setup: You order a package and pay for hosting and domain registration.
Once I have access to the services and they are live, I will begin my work.

Project Commencement: I require 50% of the package payment to start my work on your project.

Website Creation: I will create the website as per your request.

Final Delivery: I will make necessary changes and deliver the final package.

Refund Policy

If you cancel the project after Stage 2, I will refund 50% of the package payment.
Please note that hosting and domain registration fees are non-refundable and should be requested directly from the service providers.

If you cancel the project after Stage 3, I will refund 25% of the package payment.

Once you provide final directions and I complete the project, there will be no refunds available.

Amendments to Project Proposal

You must notify me of any changes to the project proposal or agreement by email, and I will review and respond to your email.
Only upon my written response will the changes be considered acknowledged.

Changes to the project proposal or agreement may affect the project timeline, delivery date, and refund structure.

Termination

Either party may terminate the agreement upon written notice to the other party.
Upon termination, I will return all client data and materials.
However, I reserve the right to hold any payment that has already been made or demand payment for any outstanding invoices.

Confidentiality

I agree to maintain confidentiality of all client information and data.

Intellectual Property

You are granted a non-exclusive license to use the work for your business purposes.
I retain all intellectual property rights to the work produced, including but not limited to.

Data Protection

I agree to comply with the General Data Protection Regulation (GDPR) and ensure that all personal data is processed in accordance with the GDPR principles.
You are responsible for ensuring that you comply with the GDPR as well.

Force Majeure

MercProWeb shall not be liable for any failure to perform its obligations due to circumstances beyond its control.
Including but not limited to natural disasters, war, or government regulations.

Limitation of Liability

I’m committed to helping your business thrive online, and I’m passionate about delivering high-quality services that meet your needs.
However, I want to be clear that my services are designed to provide you with a solid foundation for your online presence, but I’m not directly responsible for your business’s success or failure.
While I care deeply about your business’s growth and success, I’m not liable for any losses or damages that may occur as a result of using my services.

Changes to Terms

I reserve the right to modify these Terms at any time.
You are responsible for reviewing the updated Terms by visiting this website.
I am not obligated to provide notifications of changes to these Terms.

Warranties and Representations

I warrant that the services will be performed in a professional and workmanlike manner, with the goal of meeting and exceeding your expectations.
